Terms & Conditions

By booking a yacht charter with Cruise Asia Marine Co. Ltd., you agree to the following Terms & Conditions. These terms apply to all clients and all charters on our vessels unless otherwise agreed in writing.
1. Booking
By confirming a booking with Cruise Asia Marine Co. Ltd., you enter into a contract governed by these Terms & Conditions.
- 1.1 Booking request. To book a trip, you must first confirm availability with us and notify our team of your preferred dates and charter type.
- 1.2 Invoice & deposit. Once availability is confirmed, we will issue an invoice describing your charter, the deposit due, and the remaining balance. The deposit is due immediately after the invoice has been sent.
- 1.3 Payment confirmation. After transferring the deposit, please send us proof of payment (e.g. transfer slip). Once funds are received into our account, we will send a written booking confirmation.
- 1.4 Non-payment. Cruise Asia reserves the right to release the charter and sell it to another party if the deposit or balance is not received within the stated deadlines.
- 1.5 Discounted charters. All discounted or promotional charters are strictly non-refundable.
2. Altering a Booking
- 2.1 Minor changes. Minor changes (e.g. guest names, dietary notes) are usually free of charge, provided they do not interfere with our schedules.
- 2.2 Major changes. Major alterations that affect our charter schedule (e.g. dates, yacht type) may be treated as cancellations and re-bookings, and standard cancellation fees may apply.
3. Payments
3.1 Methods & currencies
Payments are to be made using the methods approved by Cruise Asia at the time of booking. Bank transfer is the preferred payment method. We accept:
- Thai Baht (THB)
- Euro (EUR)
- US Dollar (USD)
Currency conversion is based on the Google exchange rate on the invoice date. For EUR or USD cash payments, the exact amount is required as we do not carry change in those currencies.
3.2 Service & administration fee
- A 5% service fee applies to all bookings.
- This fee is waived for payments by bank transfer or cash (no additional charges).
- For cryptocurrency or PayPal payments, a 10% surcharge applies.
3.3 Payment deadlines
Deadlines vary depending on charter type, as follows:
- Day charters. 50% deposit at booking; remaining balance due at least 7 days before departure. Bookings made less than 7 days in advance must be paid in full.
- Overnight charters. 30% deposit at booking; remaining balance due at least 45 days before departure. Bookings made less than 45 days in advance must be paid in full.
3.4 Responsibility for full amount
You are responsible for ensuring that the full charter amount stated on the invoice is received in our designated account by the invoice due dates. All bank, processing, or currency conversion fees are to be borne by the client.
3.5 Late or non-payment
If full payment is not received by the deadline:
- Cruise Asia may cancel the charter without refund of any amounts already paid.
- A 10% late fee may be applied to the outstanding balance.
- Boarding may be denied.
4. Cancellations & Insurance
4.1 How to cancel
Cancellations must be made in writing via email. The date we receive your email is the date used to calculate any cancellation fee.
4.2 Cancellation fees
4.2.1 Day charters
- More than 14 days before charter: €100 administration fee.
- Less than 14 days before charter: 50% of the full charter fee.
- Less than 7 days before departure: 100% of the charter fee.
4.2.2 Overnight charters
- 60 days or more before charter: €100 administration fee.
- Between 60 and 45 days before charter: 30% of the total charter fee.
- Less than 45 days before charter: 100% of the charter fee.
4.3 Unsafe weather
If the weather is deemed unsafe by the Thai Meteorology Department, Cruise Asia will cancel the charter and first offer an alternative date. If this is not possible, a full refund will be provided.
4.4 Guest-initiated cancellation during charter
If guests decide to terminate the charter once it has started, no refund is provided for the unused portion.
4.5 Late arrival
If you or any of your group arrive late to the embarkation point for reasons not attributable to Cruise Asia, the charter end time remains unchanged. No refund or partial refund is provided for lost time.
5. Force Majeure
Cruise Asia is not liable for any failure to perform or for delays caused by events beyond our reasonable control, including but not limited to:
- War, civil unrest, terrorism, strikes, or industrial action
- Natural disasters, fire, pandemics, or public health emergencies
- Airport, port, or border closures and congestion
- Serious technical or mechanical failures
- Adverse or unsafe weather conditions
6. Safety
- 6.1 Captain’s authority. The captain has full authority over the yacht, itinerary, and safety decisions. Routes may be changed at any time if deemed necessary. No refunds apply due to route changes.
- 6.2 Itinerary flexibility. All itineraries are indicative and may change due to weather, sea conditions, or operational reasons.
- 6.3 Following crew instructions. Guests must comply with all safety briefings and crew instructions. We reserve the right to terminate the charter without refund if guest behavior endangers safety.
- 6.4 Intoxication. Our insurance does not cover intoxicated guests. Guests who consume alcohol or other substances do so at their own risk and may be restricted from certain activities or areas of the yacht.
- 6.5 Ignoring recommendations. Cruise Asia accepts no liability for incidents occurring when guests ignore crew safety recommendations.
7. Liability
- 7.1 Client acts and omissions. Cruise Asia is not responsible for the acts or omissions of clients and shall not be liable for claims made against them by other guests or third parties.
- 7.2 Unforeseeable losses. We accept no liability for losses that were not caused by our breach or could not reasonably have been foreseen at the time of booking.
- 7.3 Personal belongings. Cruise Asia is not responsible for loss, theft, or damage of personal items, especially electronics. Guests are advised to bring waterproof protection and ensure personal insurance coverage.
- 7.4 Damage to vessel. Guests may be charged for any damage caused to the yacht or its equipment due to negligence, misuse, or intentional acts.
8. Holiday & Cancellation Insurance
We strongly recommend that all guests hold comprehensive travel insurance that covers:
- Trip cancellation and curtailment
- Medical treatment and evacuation
- Sailing and watersports activities
- Loss or damage of personal possessions
Except as explicitly stated in Section 4 (e.g. unsafe weather), no refunds are provided for cancellations or interruptions outside our control.
9. Equipment Breakdown
- 9.1 Complex systems. Yachts are complex machines. Despite regular maintenance, equipment failure can occur.
- 9.2 Minor issues. No refund is provided for minor technical issues that do not materially affect the overall charter experience.
- 9.3 Significant issues. If Cruise Asia is unable, even through no fault of its own, to deliver the chartered yacht or a similar yacht at the start of the charter, we will refund a pro-rata portion of the charter fee.
10. Complaints
- 10.1 Raise issues immediately. If you have a complaint, please inform the skipper (or shore base for bareboat charters) immediately so we can attempt to resolve it on the spot.
- 10.2 Escalation. If the issue cannot be resolved on board, contact us directly on +66 8008 25086 during the charter.
- 10.3 Written follow-up. If you remain dissatisfied, a written complaint must be sent within 14 days after the charter, signed by the lead guest.
- 10.4 Resolution. If a complaint is deemed fair, we may offer a partial or full refund at our discretion.
11. Information Provided
All information published regarding yachts, itineraries, prices, crews, and services is correct to the best of our knowledge at the time of publication. However, Cruise Asia reserves the right to amend details as required without prior notice.
Any information provided by automated tools, including AI or chatbots, is for guidance only. Only the official written invoice and written communications from Cruise Asia are legally binding.
12. Price Changes & Promotions
We reserve the right to change prices and run promotions at any time. The price confirmed at booking remains valid for that charter, but later promotions cannot be retroactively applied.
Cruise Asia is not responsible for extra fees or mark-ups charged by third-party agents. Any such disputes must be resolved directly with the agent.
13. Intellectual Property & Privacy
All content on Cruise Asia’s website (text, logos, images, and videos) is protected by copyright and may not be reused without permission, except for promotional purposes directly related to our services.
We may use photos and video captured on our charters for marketing unless you explicitly request otherwise in writing. For more details, please see our Privacy Policy.
14. Additional Terms
- 14.1 Complex bookings. A surcharge of up to 20% may apply for highly customized bookings such as weddings, corporate events, or charters requiring extensive planning and communication.
- 14.2 “Best Weather” guarantee. If a client wishes to purchase a double-rate “Best Weather” guarantee (subject to our acceptance), we will refund if there is heavy rain or adverse sea conditions on the charter day. Otherwise, standard weather policies apply.
15. Final Note
By booking with Cruise Asia Marine Co. Ltd., you confirm that you have read, understood, and agreed to these Terms & Conditions.
These terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be submitted to the jurisdiction of the Thai courts. If any clause is found unenforceable, the remaining clauses remain in full effect.
